What to Bring

Clothes and shoes that are comfy, and you don’t mind getting wet. A long sleeved rashie works a treat, and board shorts are quite good too!

Spare shoes to get changed into after the session.

Sunnies and a hat to protect you from the sun

For the colder months - layer up, early mornings and evenings can get a bit nippy.
We can also provide splash/windproof clothing for the winter season. ($5 cleaning fee will apply per item.)

Who Can Come
All fitness levels are welcome! Couples or children (from 12 yo) can benefit greatly from our double kayaks! Sit at the front and take it easy, just take photos or take regular breaks paddling, as the double kayaks can be operated and manoeuvred easily by the person sitting in the back alone!

Sunrise session: we welcome all experience levels at this session, children from 12 yo and beginners also welcome

Opera House kayak: water traffic is a bit more busy at this time, water may be slightly more choppy, if you have any kind of paddling experience, you'll be fine

Sunset/City Light session: we invite experienced paddlers to these sessions, customers that are able to control their kayaks

Weather Policy
If we feel we need to cancel due to the weather, we will notify you by the afternoon prior to the proposed dates, usually by around 5pm. Your safety is priority to us, therefore if it’s forecasted too windy or rainy, we will offer you an alternative day to reschedule.
(If you’re unable to attend a later day, please get in touch with us)
We reserve the right to cancel the session on the spot if we decided it is unsafe to go ahead.

Terms and Conditions
This website is operated by Sydney Kayak Experience. Throughout the site, the terms “we”, “us” and “our” refer to Sydney Kayak Experience. Sydney Kayak Experience offers this website, including all information, tools and Services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.
Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any Services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.
We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. Participants are required to explicitly consent to these terms and conditions by endorsing the digital Agreement (waiver sent by smartwaiver) form provided at the time of booking. This Agreement constitutes a binding legal contract and must be completed and signed in its entirety as a precondition to participating in the kayaking activities.

Having Participants actively sign a waiver demonstrates that they have been cognisant of a risk warning in the strongest possible way. If you do not consent to our terms and conditions and wish to cancel your kayaking session, please inform us accordingly. Please be advised that our cancellation policy will apply to all bookings, regardless of whether you sign the terms and conditions or if you disagree with them. Participation in the kayaking activities is dependent upon your acceptance and signing of these terms and conditions.

Risk warning under section 5M of the Civil Liability Act 2002 (NSW)
I acknowledge, agree and understand that:
the types of activities undertaken at Penrith Whitewater Stadium which carry significant risk of personal injury include (but are not limited to): kayaking with Sydney Kayak Experience. https://legislation.nsw.gov.au/view/html/inforce/current/act-2002-022#sec.5M -
The Participant acknowledges to Sydney Kayak Experience that the Participant does not have any physical limitations, medical ailments or physical or mental disabilities that would limit or prevent the Participant from participating in the Activity. Participants must inform us of any known health or medical conditions or disabilities affecting them, as well as any prescribed medication they may be using.

Participants agree to wear the Australian standard PFD supplied while on the water.

Participants agree that they are not under the influence of drugs or alcohol. Sydney Kayak Experience reserves the right to refuse any participants if we feel they are under the influence of alcohol or drugs or are not respecting instructions. Refunds will not be provided.

Participants are not allowed to smoke or vape during our tours.

Participants agree to the following weight limits:

Single Kayak: Maximum Capacity: 140 kg (Cockpit Width: 23.5″ / 60 cm)

Double Kayak: Combined Maximum Capacity: 170 kg

During our morning sessions launching from Milson Park, please walk on our marine-grade non-slip carpets. We do not take responsibility for any injuries sustained from walking on the boat ramp (Including in Lavender Bay during our sunset tours).

Participants are expected to act responsibly during kayaking activities with Sydney Kayak Experience. They must strictly follow all instructions, rules, warnings, and guidelines provided by our staff, whether written, displayed on signs, verbally communicated, or shared in any other form, to ensure the safety and enjoyment of everyone involved.

Participants are required to inform Sydney Kayak Experience staff immediately if they experience or witness any incidents or accidents resulting in personal injury or illness during any kayaking activities. An incident form must be completed and signed by the participant and Sydney Kayak Experience staff or contractor.

Medical Costs.
Participants understand and agree that Sydney Kayak Experience is not responsible for any medical costs incurred as a result of an accident or injury during the kayaking tour. Participants accept full financial responsibility for any and all medical expenses that may arise from participation in the tour. -
We strongly recommend that travellers purchase full travel insurance.

Photographs, video capture​

Photographs obtained from Sydney Kayak Experience remain copyright to Sydney Kayak Experience and may only be used or reproduced by the paddler or recipient for private or domestic purposes and must not be used for any commercial purpose, including promotion of any supplier or any supplier’s products or services, without Sydney Kayak Experience’s prior written permission.

Paddlers agree that Sydney Kayak Experience and its authorised sub-contractors have the authority to use and reproduce any photograph taken of a paddler for any disclosed purpose including display and purchase by or on behalf of paddlers, without prior notice or payment of compensation to the paddler.

Paddlers that do not agree to having their photographs taken, must advise the Kayaking Guide prior to commencement of the Kayaking Activity.

Cancellations and refund policy:

We can cancel or change the kayaking activity based on the weather and other conditions on the day of the tour. Cancellation by Provider If Conditions Are Unsafe: If we decide the conditions are not safe before the tour starts, we’ll offer you a new date, store credit, or a 90% refund. We decide based on the weather on the day. If Conditions Are Safe but You Cancel: If the conditions are safe and you decide not to go, we cannot offer a refund or reschedule. If Conditions Change During the Activity: If conditions become unsafe during the activity, we’ll offer you a new date, store credit, or a 90% refund. We won’t cover any inconvenience caused by the cancellation. 3Cancellation by Participant More than 7 Days Notice: You can get a 90% refund or choose a new date. We keep 10% to cover our fees. 3-7 Days Notice: We’ll offer a new date with a 10% rebooking fee. No refunds. Less than 72 Hours or No Shows: No refunds, new dates, or store credit. If you booked a double kayak and one person doesn’t show, we can’t provide a single kayak, and the booking will be canceled. Kayaking with Sydney Kayak Experience is an all-weather experience, kayaking during the time of the Sunrise, mid-morning, or Sunset we cannot guarantee what the sunrise/sunset or weather will be. Participants are able to purchase rain jackets and pants, suitable for kayaking($5 cleaning fee will apply).

Section 139A of Competition and Consumer Act, 2010 (Cth) permits Sydney Kayak Experience, the provider of the Kayaking Activity and associated services, to ask you to agree that the statutory guarantees under the Australian Consumer Law (Cth) do not apply to you.

Release of liability acknowledgment/risk warning

Paddler’s acknowledge that warning has been given about the risk of suffering personal injury or death arising from or in connection with participation in activities.

Falling into water or being affected by other foreseeable risks associated with paddling, swimming, entering and exiting the kayak and using the kayak and other associated equipment
-
Extremes of weather including sudden and unexpected changes and/or other natural occurrences such as the presence of any kind of marine life which may harm you in any way or form (such as the presence of blue bottles)

being involved in an accident or contracting an illness in any case, generally or requiring the assistance of medical / emergency services.

Waiver in relation to recreational services to which the Australian Consumer Law applies:

By signing our waiver, you recognize, accept, and comprehend that the risk warnings provided herein serve as an official 'risk warning' in accordance with applicable laws, including but not limited to:
i. Section 5M of the Civil Liability Act 2002 (NSW)
Explanation: In New South Wales, Section 5M states that if a provider gives a risk warning to participants, they are not liable for any harm resulting from those risks. By signing this document, you acknowledge that you have been given a risk warning as required by this law.
ii. Section 5I of the Civil Liability Act 2002 (WA)
Explanation: In Western Australia, Section 5I provides that a person is not liable for harm suffered by another person as a result of the materialization of an obvious risk of a dangerous recreational activity. By signing this document, you agree that you understand the risks involved in kayaking and accept them, fulfilling this legal requirement.
iii. Section 48 of the Consumer Affairs and Fair-Trading Act (NT)
Explanation: In the Northern Territory, Section 48 outlines that a person who undertakes a recreational activity accepts the risks that come with it. Signing this document means you acknowledge and accept these risks as defined by the law.
iv. Section 43 of the Civil Law (Wrongs) Act 2002 (ACT)
Explanation: In the Australian Capital Territory, Section 43 indicates that if a risk warning is provided to participants, the provider is not liable for any harm resulting from the risks outlined. By signing this document, you acknowledge the risk warning in accordance with this law.
v. Sections 13-19 of the Civil Liability Act 2003 (QLD)
Explanation: In Queensland, Sections 13-19 cover various aspects of liability and risk, including the requirement that participants in recreational activities accept the risks involved. By signing this document, you agree that you have been warned of the risks and accept them, fulfilling these sections of the law.
Summary
By signing this document, you are acknowledging that you have received a risk warning, understand the risks involved in the kayaking activity, and accept these risks as outlined by the relevant laws in each of these states or territories. This formalizes the provider's compliance with the legal requirements for issuing a risk warning, potentially limiting their liability.

Acceptance of risk/release and indemnity All paddlers irrevocably undertake in favour of Sydney Kayak Experience:

That participation in any Kayaking Activity with Sydney Kayak Experience is at their own risk.

To the extent permitted by law (including under section 139A of the Competition and Consumer Act 2010 (Cth) and the to release Sydney Kayak Experience and its agents, contractors and employees from all liabilities for any actions, claims, demands, losses, damages, costs and expenses arising from any death or injury to any persons and damage to, or loss of, any property, which may be suffered or sustained as a result of paddlers participation in any of the Kayaking Activity/s with Sydney Kayak Experience.

To indemnify Sydney Kayak Experience and its agents, contractors and employees against all actions, claims, demands, losses, damages, costs and expenses suffered or incurred in relation to paddlers participation in any of the Kayaking Activity/s with Sydney Kayak Experience.

Paddlers agree that Sydney Kayak Experience holds, and may enforce, the release and indemnity in respect of the above.
